Essay on POCSO Act 2012

The POCSO Act was enacted in 2012 and came into force on 14 November 2014. POCSO Act 2012 Means The Protection of Children from Sexual Offences Act 2012. POCSO Act 2012 was enacted to protect children from Sexual Offences. According to the POCSO act child means, Any person under the age of 18 years. The pocso act defines different terms of sexual offences against children. i.e Penetrative sexual assault.,Aggravated penetrative sexual assault, Sexual assault, Aggravated sexual assault, Sexual harassment. the Pocso act also made provision for punishment of these sexual offences against children.

The pocso Act prohibits the use of children for pornographic purposes. use of children for the purposes of sexual gratification includes representation of the sexual organs of the child, use of a child in sexual activity and the indecent or obscene representation of a child. These acts are punishable under sections 14 and 15 of the POCSO act.

to record the statement of a child it must be recorded at the residence of the children or the place of his choice or place where he/she usually resides. the statement of the children must be recorded practicable by a women police officers. That the police officer must not be in uniform. And the t important provision of the pocso act is while investigating it is the duty of police officers to avoid any contact of children with the accused, Not to detained any children in PS in the night and to protect the identity of the child from media.

The child has the right to take the assistance of a legal practitioner. The special court shall conduct a trial under the POCSO act. The trial of the case shall be conducted in camera and in the presence of the parent or guardian of the child
