MAY IT PLEASE YOUR HONOUR THAT:

The applicant above named have been arrested by _______Police Station on / /202 in crime numbered above duly registered with them.
After their arrest, the applicant was produced before Ld. J.M.F.C., court, who on perusing remand report was pleased to remand him to the police custody initially. However, the applicant was later on remanded to magisterial custody. The applicant states that he has been arrested on //20 till today, therefore, the period mentioned in 167(2) of Cri. P.C. i.e. _ days has already completed.
Therefore, The applicant prefers this Application before this Hon’ble Court U/S. 167(2) for their release on bail, on the following grounds:

GROUNDS


i.) The applicants state that he has been arrested on //20__ and the 90 days period has been completed on //20__ from the date of arrest of the Applicant/Accused.
ii.) The applicant state that, therefore, the Police ought to have filed Charge Sheet within 90 days from the date of arrest of the Applicant/ accused i.e. on //. However, no charge sheet has been filed by the Police Station till the end of //20;
iv.) The applicant state that, In the circumstances, the police were obliged to file charge-sheet within a period of 90 days, which they have failed to do;


v.) The Applicant submits that, he is ready and willing to furnish the bail/surety, as this Hon’ble Court may deem fit and proper. ;
vi.) The applicant is a permanent resident of above-given address;
vii.) The Applicant undertakes to abide with the terms, that may be imposed by this Honourable Court;

It is, therefore, prayed that Your Honour may be pleased to enlarge the Applicant on bail, on such terms as Your Honour may deem fit and proper.
